The 574 Federally Recognized Indian Tribes in
January 18, 2024
the United States
Mainon A. Schwartz
A federally recognized Tribe is one that is generally “eligible for the special programs and
Legislative Attorney
services provided by the United States to Indians because of their status as Indians.”
Federal
recognition (also called
federal acknowledgment) thus engenders certain rights and protections
for a recognized Tribe, including limited sovereign immunity and powers of self-government.
There are currently 574 federally recognized Indian Tribes in the United States, according to the
annual list published by the Department of the Interior’s Bureau of Indian Affairs.

The 574 Federally Recognized Indian Tribes in the United States
Federal Recognition
Federal recognition (sometimes called
federal acknowledgment)1 is a term of art formalizing a
government-to-government relationship between the United States and a particular Indian Tribe.2
A federally recognized Tribe is generally “eligible for the special programs and services provided
by the United States to Indians because of their status as Indians.”3 Accordingly, federal
recognition engenders certain rights and protections for a recognized Tribe, including limited
sovereign immunity and powers of self-government.4 Of the 574 federally recognized Tribes, 347
are located within the forty-eight contiguous states; 227 are located in Alaska.
Under current federal law,5 a group of Indians may obtain federal recognition in three ways: (1)
via the Federal Acknowledgment Process, an administrative process overseen by the U.S.
Department of the Interior (DOI);6 (2) by congressional act;7 or (3) pursuant to a decision of a
U.S. court. However, courts in the modern era have generally declined to consider granting
federal recognition.8 As a result, groups wishing to obtain federal recognition typically must do so
either through the Federal Acknowledgment Process or by lobbying for congressional
recognition.9
Since 1994, pursuant to Congress’s statutory instruction, the DOI has published an annual list in
the
Federal Register of Tribes that have received federal recognition through any means.10 The

Id.;
see also, e.g., Kahawaiolaa v. Norton, 386 F.3d 1271, 1273 (9th Cir. 2004) (“Federal recognition affords
important rights and protections to Indian tribes, including limited sovereign immunity, powers of self-government, the
right to control the lands held in trust for them by the federal government, and the right to apply for a number of federal
services.”).
5
See Federally Recognized Indian Tribe List Act of 1994, , § 103(3), 108 Stat. 4791. By contrast, “[h]istorically,
federal recognition could arise from treaty, executive order, or course of dealing.” Agua Caliente Tribe of Cupeño
Indians of Pala Rsrv. v. Sweeney, 932 F.3d 1207, 1213 (9th Cir. 2019) (citing
Kahawaiolaa, 386 F.3d at 1273).

See CRS Infographic IG10038,
Federal Recognition of Indian Tribes: The Administrative Process, by Mainon A.
Schwartz (2023); 25 C.F.R. pt. 83. The Office of Federal Acknowledgment (OFA) currently administers these
regulations under the oversight of the DOI’s Assistant Secretary for Indian Affairs. No tribe has achieved federal
recognition through the administrative process since 2016.
7 For example, Section 2870 of the National Defense Authorization Act for FY2020, which recognized the Little Shell
Tribe of Chippewa Indians of Montana, declared “Federal recognition is extended to the Tribe” and directed the
Secretary of the Interior to acquire land in trust for use as a tribal land base., § 2870(c), (g), 133 Stat. 1198, 1908
(2020).
8
See, e.g., Wyandot Nation v. United States, 858 F.3d 1392, 1401-02 (Fed. Cir. 2017) (collecting cases and noting “the
long history making clear that tribal recognition is a political question committed to the political branches”);
accord Chinook Indian Nation v. Zinke, 326 F. Supp. 3d 1128, 1139-40 (W.D. Wash. 2018) (“[T]he issue of federal
acknowledgment of Indian tribes is a quintessential political question that must be left to the political branches of
government and not the courts. Absent a clear delegation of authority from Congress, the Court cannot bypass the
existing federal acknowledgment process and bestow federal recognition upon [a tribe].”).
9
Agua Caliente Tribe, 932 F.3d at 1215 (“The two primary ways of obtaining recognition today are through a
Congressional process or the Part 83 petition process.”).
10 Federally Recognized Indian Tribe List Act of 1994, , § 104 (codified at 25 U.S.C. § 5131) (directing Secretary of
the Interior to publish an annual “list of all Indian tribes which the Secretary recognizes to be eligible for the special
programs and services provided by the United States to Indians because of their status as Indians”).
