Congressional Veto Legislation: 97th Congress

This report has two purposes: first, to describe briefly the main features of each kind of congressional veto procedure, and second, to list under appropriated categories all such provisions submitted in the current Congress that have been located.

Recent emphasis i n an i n c r e a s i n g number of bills has been t o r e q u i r e c o n g r e s s i o n a l review and to permit possible rejection of p r o p o s e d ( a n d i n some c a s e s e x i s t i n g ) r u l e s a n d r e g u l a t i o n s . Although much d i s c u s s e d , c o m p a r a t i v e l y few such p r o v i s i o n s have been e n a c t e d i n t o law. Uniformity or standardization of procedure has not been a leading c h a r a c t e r i s t i c of c o n g r e s s i o n a l v e t o d e v i c e s . Agreement w i t h Committees of IB81138 4 Both Houses UPDATE-11/24/82 ( 5 laws w i t h 5 p r o v i s i o n s ) Four s t a t u t e s e n a c t e d between 1944 and 1952 r e q u i r e d t h a t , b e f o r e certain military o r naval r e a l e s t a t e transactions o r construction projects could be carried out, che secretaries of the respective departments involved must f i r s t "come i n t o a g r e e m e n t u w i t h t h e a p p r o p r i a t e House a n d S e n a t e c o m m i t t e e s . A more r e c e n t a c t (P.L. 96-79) directed the secretary of a particular d e p a r t n e n t t o " c o n s u l s w i t h " S e n a t e and House Committees b e f o r e promulgating certain regulations. Although n o t s p e c i f i c a l l y c o n f e r r i n g power of approval or disapproval as such, these laws d o m o r e t h a n stipulate advance n o t i f i c a t i o - n of proposed e x e c u t i v e a c t i o n s . Although i n one sense this may seem t o b e more i n t h e n a t u r e of a d i r e c t i v e t h a n a n a p p r o v a l p r o c e d u r e , s u c h a p r o p o s e d j o i n t s t u d y c o u l d n o t b e made u n l e s s a t l e a s t o n e committee gave i t s consent. XIV. A p p r o v a l by t h e Chairman o f a Committee (1 l a w w i t h 1 provision) Under one s t a t u t e an e x e c u t i v e agency must obtain the assent of a committee chairman b e f o r e carrying out a particular proposal. Congress p r o v i d e d i n 1952 ( 2 . L . 82-547) t h a t a Budget Circular controlling certain only d e p a r t m e n t a l and a g e n c y m a t t e r s c o u l d be amended b y t h e Budget D i r e c t o r wlth the prlor consent of the Chalrman of the House Committee on Appropriations. XVI. A p p r o v a l by a C o n g r e s s i o n a l Agency-STA (1 l a w w i t h 1 provision) In 1979 Congress r e q u i r e d (P.L. 96-15i) t h a t t h e p r o t o c o l f o r a study to Veterans Administration must first be reviewed and be conducted by t h e a p p r o v e d by t h e D i r e c t o r o f t h e O f f i c e o f Technology Assessment (OTA), a separate type congressional agency.
