      "summary": "This report discusses recent legal developments regarding the right of state employees to bring\nsuit\nunder federal law. On January 11, 2000, the United States Supreme Court decided  Kimel v.\nFlorida\nBoard of Regents . The case addressed the right of state employees to bring suit under the Age\nDiscrimination in Employment Act (ADEA). The ADEA prohibits discrimination in employment\nbased on age. The Court held that state employees cannot bring suit against the state to enforce the\nADEA because of sovereign immunity. A related case brought by a state employee under the\nAmericans with Disabilities Act (ADA) is awaiting response from the Supreme Court. Under the\n11th\nAmendment of the U.S. Constitution, states are immune from suit unless the state consents or an\nexception applies. This is not the first time the Court has addressed the scope of states' rights. The\n Kimel  case reflects a growing jurisprudence governing the interaction between the\nfederal\ngovernment and states. This issue has a direct impact on Congress' ability to enact legislation,\nparticularly labor laws, that apply to state employees. This report also discusses  Seminole Tribe\nof\nFlorida v. Florida ,  Alden v. Maine ,  City of Boerne v. Flores ,  Ex\nParte Young , and  Florida Prepaid\nPostsecondary Ed. Expense Bd. v. College Savings Bank .",
