Summary
On February 19, 2011, the House passed H.R. 1, the Full-Year Continuing Appropriations Act,
2011. H.R. 1 would provide appropriations to federal agencies for the remainder of FY2011.
Based on specific congressional interest in the level of appropriations that H.R. 1 would provide
for the Departments of Education and Labor for FY2011, this report provides proposed program-
by-program funding levels for programs in these departments that receive funding through the
annual Labor, Health and Human Services, and Education, and Related Agencies
Appropriations Act. Subsequently, on March 1, 2011, the House passed the Further Continuing
Appropriations Amendments, 2011 (H.J.Res. 44) to extend government operations through March
18, 2011, while modifying funding for several ED and Labor programs relative to their FY2010
funding levels. The following day, the Senate passed H.J.Res. 44.

Proposed FY2011 Appropriations for the Departments of Education and Labor

Overview
On February 19, 2011, the House passed H.R. 1, the Full-Year Continuing Appropriations Act,
2011. H.R. 1 would provide appropriations to federal agencies for the remainder of FY2011.
Based on specific congressional interest in the level of appropriations that H.R. 1 would provide
for the Departments of Education and Labor for FY2011, this report provides proposed program-
by-program funding levels for programs in these departments that receive funding through the
annual Labor, Health and Human Services, and Education, and Related Agencies Appropriations
Act (Table 1 and Table 2). The House-passed appropriations levels for FY2011 are included in
the tables, as are appropriations for these programs for FY2010. If H.R. 1 did not make changes
to a particular program, the FY2010 appropriations level has been included as the FY2011
program funding level. Following the appropriations tables is a third table that provides contact
information for CRS analysts who cover specific program areas that may be affected by changes
proposed in H.R. 1 (Table 3).
Subsequently, on March 1, 2011, the House passed the Further Continuing Appropriations
Amendments, 2011 (H.J.Res. 44) to extend government operations through March 18, 2011,
while modifying funding for several ED and Labor programs relative to their FY2010 funding
levels. The following day, the Senate passed H.J.Res. 44. Table 1 and Table 2 depict the
proposed changes for all ED and Labor programs, respectively, that would be affected by
H.J.Res. 44.

a. This reflects the program funding level provided under P.L. 111-117. P.L. 111-226 rescinded $50 million
from this program.
b. No funds would be provided for the Education for Native Hawai ans or Alaska Native Education Equity
program for FY2011 under H.R. 1. An accepted amendment to H.R. 1 (H.Amdt. 60) would al ow ED to
provide funds to these programs (that would otherwise be considered earmarks under House Rules). It is
unclear whether or how ED would use this flexibility.
c. The Academies for American History and Civics Program is authorized under the American History and
Civics Education Act (P.L. 108-474), but funding for the program is provided based on authority available
under Title V-D-1 of the ESEA. The specific provision of funds for this purpose is detailed in the Conference
Report accompanying P.L. 111-117 (H.Rept. 111-366).
d. Per H.J.Res. 44, no program authorized under ESEA Title II-A-5 would receive FY2011 funding. This would
affect both the Advanced Credentialing program (ESEA Section 2151(c)) and the School Leadership program
(ESEA Section 2151(b)). The elimination of the School Leadership program, which is not considered an
earmark under House Rules, would result in a lower level of funding than the level specified in H.J.Res. 44 as
being needed for programs in the Innovation and Improvement account. Based on a conversation with
House Committee on Appropriations staff, it does not appear that it was intended for the School
Leadership program to be eliminated. However, it is unclear when, or if, a technical correction would be
made with respect to this program.
e. Under P.L. 111-117, the Secretary was permitted to use up to $23.082 million from the Charter Schools
Program for Credit Enhancement for Charter School Facilities and Charter School Per-Pupil Facilities Aid
Programs (ESEA, Section 5205(b)). H.R. 1 would also permit the Secretary to use up to $23.082 million
from the Charter Schools Program for these purposes.
f.
This reflects the program funding level provided under P.L. 111-117. P.L. 111-226 rescinded $10.7 million
from this program.
g. Continuing grants for Character Education were supported through Safe and Drug-Free Schools and
Communities National Programs. A total of $8.2 million was provided for this purpose.
h. Per H.J.Res. 44, $2.578 million was to remain available for continuation grants under the Cooperative
Education Exchange program. If this level of funding is retained, it would result in a lower level of funding
than the level specified in H.J.Res. 44 as being needed for programs in the Safe Schools and Citizenship
account. Based on a conversation with House Committee on Appropriations staff, it appears that it was
intended that $3.345 million was to be retained for the aforementioned purpose. However, it is unclear
when, or if, a technical correction would be made with respect to this program.
i.
H.R. 1 includes a discretionary rescission of $986.434 million of mandatory funding from Academic
Competitiveness and SMART Grants. Based on conversations with House Committee on Appropriations,
this rescission may be dropped and therefore has not been included in the table.
j.
While the level of appropriations provided for Pel Grants under H.R. 1 for FY2011 would be identical to
those provided for FY2010, H.R. 1 would make other changes to the Pel Grant award amount that affect
the interplay between discretionary Pel Grant awards and the mandatory add-on Pell Grant awards. These
changes would have a substantial negative effect on future increases to Pell Grant awards funded with
