U.S. Circuit and District Court Nominations:
Resubmissions, 1977-2003
Summary
At the beginning of the 108th Congress, President George W. Bush resubmitted
13 U.S. circuit court and 16 U.S. district court nominations of persons previously
nominated by him or other Presidents to the same positions. These nominations
represent a rare, but occasional, occurrence in the judicial appointment process.
The Senate usually confirms the judicial nominations it receives from the
President during each Congress. There are, however, occasions when a nomination
does not receive Senate confirmation. At these times, the nomination may be either
withdrawn by the President or returned to him by the Senate. Many of these
nominations are never submitted again, but others are, in the same or a subsequent
Congress. These nominations are often called resubmissions or resubmitted
nominations
. In most cases, a resubmission is made by the same President who
submitted the original nomination. In a few cases, however, the resubmission is
made by a different President. Individuals nominated to different positions are not
considered to have been renominated.
In total, 175 individuals were nominated two or more times to circuit or district
judgeships during the period from 1977 through 2003. Fifty-five nominees were
resubmitted for circuit court positions and 120 for district court positions. In 11 of
the 175 cases, two Presidents of opposing political parties nominated the same
individuals to the same positions. In the remaining cases, individuals were
nominated more than once to judgeships by the same President or by Presidents of
the same political party.

Resubmissions, 1977-2003
Introduction
As with other presidential nominations to positions that require the advice and
consent of the Senate, nominations to federal judgeships sometimes fail to advance
through the entire advice-and-consent process.1 After referral to committee, a
nomination might fail to receive a hearing or, after receiving a hearing, might fail to
receive a committee vote on whether it should be reported. Even if reported, it might
fail to receive a vote by the Senate on whether to confirm. If it fails to receive a
Senate vote, the nomination ultimately will be withdrawn by the President or returned
to the President by the Secretary of the Senate upon a Senate adjournment or recess
of more than 30 days.2 Presidents may choose to renominate the same person to the
same position. These renominations are known as resubmissions or resubmitted
nominations
.3 A majority of the judicial nominees withdrawn by the President or
returned to him by the Senate are submitted again.
A President’s ability to resubmit a nomination is not subject to time limits:
resubmissions may occur during the same Congress as the original submission or
during any subsequent Congress.4 Nor is a President limited to resubmitting his own
original nominations: although most resubmissions are made by the President who
made the original nomination, a few have been made by a different President.5

Historically, resubmissions account for a relatively small proportion of all U.S.
district and U.S. circuit court nominations. Since the opening of the 95th Congress,
for example, Presidents have submitted 1,759 district or circuit nominations, of
which 175 (9.9%) were resubmissions. As one would expect, however, the number
varies from President to President. President Carter resubmitted seven nominations
(2.4% of his 289 nominations); President Reagan, 42 (9.6% of his 438 nominations);
President George H. W. Bush, 10 (4.0% of his 253 nominations); and President
Clinton, 53 (10.7% of his 497 nominations). As of this writing, President George W.
Bush has resubmitted 68 nominations (24.1% of his 282 nominations). On the other
hand, Presidents are about as likely as not to resubmit a nomination that was
withdrawn or returned. Since the opening of the 95th Congress, 346 district and
circuit court nominations have been either withdrawn by the President or returned by
the Secretary of the Senate.6 Of those 346 nominations, 175 were resubmitted
(50.6%).
This report compiles information on and tracks U.S. district and circuit court
nominations that have been resubmitted from 1977 through 2003 (95th Congress
through the first session of the 108th Congress).
Nominees and Nominations
Debate on the efficiency of the Senate’s consideration of proposed judges
sometimes hangs on the words nominee and nomination. When these words are used
interchangeably and without regard for their different meaning, the debate can
become confusing. By definition, a nominee is the person who is selected by the
President to fill a position requiring Senate advice and consent. Each time the person
is nominated by the President to a fill a position, that instance is called a nomination.
Because of the possibility of resubmissions, the number of nominations in any
given period can be greater than the number of nominees. During the period covered
by this report, 175 nominees were nominated two or three times — a total of 366
nominations (see Tables 4 and 5, below).
Resubmissions in the 107th Congress
During most Congresses, resubmissions account for only a few of the total
number of nominations submitted. During the 107th Congress, however, the number
of resubmissions was unusually high — 20 district court and 21 circuit court
nominations. Reportedly, this resulted from the inability of the majority and minority
leaders to reach consensus on a unanimous consent agreement to maintain the status

quo on all the nominations during the 33-day recess of August 3- September 4, 2001.7
Since an agreement could not be reached, the nominations pending before the recess
were returned to the President.8 Shortly after Congress reconvened, the President
resubmitted the nominations.
Because the nominations were returned and then resubmitted, the total number
of nominations in the Congress increased. The increase in nominations meant that
the confirmation percentages for judicial nominations in the 107th Congress are
notably lower than the confirmation percentages for judicial nominees. Differences
between confirmation percentages for nominations and nominees, however, do exist
in other Congresses, but to a lesser degree than in the 107th Congress. For example,
the 107th Congress recorded more than four times as many resubmissions (41) as the
next highest number of resubmissions (9) in the 99th Congress.
Structure and Content of the Tables
Table 1 lists, for U.S. district and circuit court nominees, the number of times
their nominations were resubmitted. That is, it breaks down district and circuit court
nominees, respectively, into “Times Nominated.” Each nominee is accounted for
only once. Depending on the number of times nominated, the nominee will appear
in either the column for two nominations, three nominations, or four nominations.
No nominee during this 1977-2003 time period has been nominated five times.
Table 2 and Table 3 focus on the numbers of resubmissions and confirmations.
Table 2, starting with the 95th Congress, shows the number of unconfirmed U.S.
district and circuit court nominations in each Congress that were resubmitted in the
next Congress, and the number of those resubmitted nominations that were
confirmed. Table 3, also starting with the 95th Congress, shows the number of
unconfirmed district and circuit court nominations in each Congress that were
resubmitted later in the same Congress, and the number of these resubmissions that
were confirmed.
Table 2, resubmissions in the next Congress, is arranged chronologically by the
Congress in which each nomination was first received in the Senate. From left to
right, columns one, two, and three show the President, Congress in which the
nomination was first submitted, and Congress in which the nomination was
resubmitted. Columns four and six provide the number of resubmitted nominations
received for district and circuit court positions, respectively. Columns five and seven
show the number of district and circuit court nominees confirmed by the Senate.

Table 3, resubmissions in the same Congress, is arranged chronologically by the
Congress in which each nomination was first received in the Senate. From left to
right, columns one and two show the President and Congress in which the
nomination was first submitted. Columns three and four provide the number of
resubmitted district court nominations received and the number confirmed by the
Senate. The next two columns provide this information for circuit court nominations.

Table 4 and Table 5, respectively, provide information concerning every U.S.
circuit and district court nominee, from 1977 through 2003, who was nominated
more than once to the same judgeship. The tables list the dates each of these persons
was nominated, as well as the dates for any hearing, committee action,9 or Senate
action taken on each nomination, including roll call votes.10 Nominees in both tables
are listed chronologically by the date that their first nomination was received in the
Senate. The tables were created using data from the final committee calendars for
the 95th to 106th Congresses and the daily editions of the Congressional Record for
the 107th and 108th Congresses.
For each nominee listed, information on the initial and resubmitted nominations
is provided on split rows. For example, the first nominee listed in Table 4, Sherman
E. Unger, is shown to have been nominated to a federal circuit judgeship a first time
in the 97th Congress. This nomination, however, as the table shows, failed to receive
a committee hearing or a committee vote to report and was returned to the President
on December 23, 1982, at the end of the 97th Congress. Unger’s nomination to the
same judgeship was resubmitted twice in the 98th Congress. The first of these two
nominations, which also received no committee hearing or committee action, was
returned to the President on August 4, 1983 (at the start of the Senate’s August
recess). The second resubmitted nomination, received by the Senate on September
13, 1983, experienced five days of hearings, but received no subsequent committee
action and was returned to the President on November 18, 1983 (at the end of the
first session of the 98th Congress). All three of the Unger nominations were returned
pursuant to Senate Rule XXXI(6), which provides for the return to the President of
all nominations pending at the time the Senate adjourns or takes recess for more than
30 days.

Findings
Resubmissions from One Congress to the Next
During the 99th, 105th, and 108th Congresses, far more U.S. district court
nominations were resubmitted by the President than during the other Congresses.
The 108th Congress recorded the highest resubmission total of 27. This number was
four more than the next highest total, 23, in the 105th Congress. The 99th Congress
had 15 resubmissions. President William J. Clinton had the most instances of
resubmissions between Congresses at 53, almost twice the number of the next
President, George W. Bush, with 27 resubmissions. The President with the fewest
resubmissions between Congresses was President Jimmy Carter, with a total of 3.
Resubmissions in the Same Congress
Table 3 shows that one or more resubmissions occurred within a Congress
during six of the 14 Congresses covered in this report. The 107th Congress recorded
the most instances of resubmissions within a Congress (41), more than four times as
many as the next highest number of resubmissions (9) in the 99th Congress. The high
number of resubmissions in the 107th Congress occurred because the Senate, upon
adjourning for its August 2001 recess, returned 20 district court nominations and 20
circuit court nominations to President George W. Bush, who in turn resubmitted all
40 nominations to the Senate when it reconvened on September 4, 2001.
U.S. Circuit Court Resubmissions
During the 1977-2003 time period, Presidents Jimmy Carter, Ronald Reagan,
George H. W. Bush, William J. Clinton, and George W. Bush renominated a total of
55 U.S. circuit court nominees (see Tables 1 and 4, below). One of those nominees
was nominated by two Presidents of opposing political parties to the same position.11
The remaining 54 individuals were nominated to judgeships more than once by the
same President or by Presidents of the same political party. Two individuals were
nominated four times.12 Twelve individuals were nominated three times, and the
remaining 41 individuals were nominated two times. Thirty-four out of the 55
resubmitted nominees were confirmed.
U.S. District Court Resubmissions
During the 1977-2003 time period, Presidents Jimmy Carter, Ronald Reagan,
George H. W. Bush, William J. Clinton, and George W. Bush renominated a total of
121 U.S. district court nominees (see Tables 1 and 5, below). In 10 of the 121 cases,
two Presidents of opposing political parties nominated the same individual to the

same position.13 In the remaining cases, individuals were nominated more than once
to a judgeship by the same President or by Presidents of the same political party. Six
individuals were nominated three times.14 The remaining 115 were nominated two
times. Out of the 121 resubmitted nominees, 103 were confirmed.
